Every day, I and over 200,000  people drive along Interstate I 10 in Houston, TX.  This should be no big deal, until one realizes that I-10 (Interstate 10)  / Katy Freeway is one of the five most dangerous highways in the United States.  According to www.valuepenguin.com , “The portion of Interstate 10 that runs from Anthony, Texas, near the New Mexico state line to the border of Louisiana placed fifth in our dangerous highway rankings.”  Well, that part of the highway is about 1000 miles in length, so I figured I was safe, until I read the following: “Most fatal crashes occurred on the segment of I-10 running through Harris County. Overall, a reported total of 585 fatal crashes happened on this highway from 2010 through 2016.”  Harris County is in Houston, TX.  That is the portion of the road which I drive on daily.  Not so comforting.  Incidentally, highway US 59 and US 290, both Texas Highways in Houston TX, also made the list among the most dangerous highways in the United States.

There are precautions and measures which a car driver can do to stay safe on the highways.  First, investing in a car which has modern safety features is a must for those who drive significant distances, especially on the highway.  Years ago, safety features included anti-lock brakes and airbags.  Times have changed.  According to forbes.com “The Top 7 Car Safety Features You Cannot Do Without,” important safety features include the following

  • Adaptive cruise control
  • Automatic emergency braking
  • Land departure warning / lane keep
  • Blind spot detection
  • Rear view camera
  • Safety exit assist
  • Facial recognition software to assess the driver’s alertness

In addition to having a safe car, the driver has the responsibility to practice the skills of safe driving.  https://www.wikihow.com/Drive-a-Car-Safely provides the following guidelines as to how to drive safely.

  • How to drive a car safely
    • Behave responsibly: don’t drink and drive
    • Avoid distractions: keep your eye on the road
    • Avoid drowsiness
    • Always wear a seatbelt
    • Stay calm: don’t aggravate other drivers, and don’t get aggravated yourself
  • Following the Rules of the Road
    • Observe the speed limit
    • Follow the three second rule
    • Be more careful in poor driving conditions
    • Be wary of other drivers
    • Use mirrors and check blind spots

Regardless of how cautious we are, we cannot prevent all motor vehicle accidents or truck accidents.  At times, we might anticipate an accident, and we can try to brace ourselves for the impact.  At other times, we will be hit completely unexpectedly.  Depending upon the mechanism of the impact, these may be the most devastating collisions.

Depending upon the angle at which we are hit, we may suffer minor or very severs damage to our body, during a motor vehicle collision.  Each portion of our body is intended to have certain motions, and our bones, joints, ligaments, tendons and muscles are setup and designed this way.  When, during a sudden impact, a sudden inertial force causes a forced movement in a direction in which our body was not designed, or when the forced movement is in the direction in which it was designed, but the motion forced motion exceeds the range of motion for which our body was designed, severe damage can occur.  This can cause damage to the bones, ligaments, tendons, muscles, and spinal discs which are located between vertebral bodies of the spine.  Tears, fractures, avulsions, ruptures, sprains and strains may occur.  The mechanisms of injury, diagnosis, treatment, and healing of each may vary significantly.

After being involved in a motor vehicle injury, never underestimate the dangers of a delayed onset of symptoms.  The victim may be in shock, both emotionally and physically, and not even recognize and realize the pain which they are in.  They may be worried about other things, such as other passengers in the car, the status of their vehicle, other traffic on the road, broken glass and other debris, and may neglect the significance of the injuries and pain which they are suffering.  In addition, there are injuries which may have just begin, but will develop more significantly over time.  An epidural hematoma is a classic example of an injury in which the victim initially may suffer a loss of consciousness, only to recover, but then in a delayed manner, rapidly decline, often into unconsciousness and death.  The initial alteration of consciousness is causes by a concussion, but after awakening, the subsequent demise is cause by a torn artery bleeding around the covering of the brain (dura), leading to compression of the brain, pushing the brain to the other side of the skull, resulting in death.

Severe injuries to the low back and neck may result in torn ligaments and discs of the spine.  Initially, the victim may not fully recognize the pain which they are in, or in fact the pain may not develop until later, as the cascade of events begins.  A torn annulus fibrosis, which contains the soft nucleus pulposus of the spinal discs, may be partially torn from the initial impact, but it may undergo a progression of additional tearing once the patient undergoes more activity over the next few days after the motor vehicle collision.  This may occur in whiplash, a neck injury due to sudden, forceful, and rapid flexion and extension movements of the neck.

When encountering a significant motor vehicle collision, call immediately for help by dialing 911.  If victims are trapped inside a vehicle, and they are unable to get out due to bent and jammed door frames, firefighters may have to use the Jaws of Life, to pry open and cut the metal.  These lifesaving tools are a vital component in saving lives.  Remember, victims of a severe accident may have a spinal injury.  Police, ambulance or fire crews will have a “spine board,” which is a flat board upon which the victim can be placed, without the risk of rotating and flexing the spine.  These and other precautions help to reduce risks of paralysis, in the event there is an unstable fracture of the spine.

An Automatic Crash Response alert is available from www.onstar.com.  According to On Star, they use built-in vehicle sensors, known as Automatic Crash Response sensors, which can connect to and advisor immediately if a vehicle has been involved in a crash.  They indicate that help will arrive right away, even if the driver has not asked for it.  Advisors will notify first responders about the location of the accident, and according to On Star, also about the likelihood of serious injuries using their Injury Severity Prediction.

According to www.safercar.gov, automatic crash notification (ACN) systems can reduce death and disability by decreasing the time it takes to transport a motor vehicle collision victim from the scene of the accident, to a hospital emergency room.  The severity of injuries and the death rate may be reduced is crash victims are treated within the first hour (the golden hour) following an injury. There is no specific cutoff regarding the first 60 minutes after an injury, but it is important to realize that after suffering severe body trauma, it is best to have intensive medical evaluation and treatment as quickly as possible, to prevent long lasting disability and death.  In addition, the ACN (automatic crash notification) is particularly important in helping car accident victims when the injury occurs in a rural area, where there may be no witnesses to notify first responders.

Treat every injury seriously.  If there is even the slightest concern, it is better to be taken by ambulance to the Emergency Room.  The ER physician can assess for bone fractures, spine fractures, contusions in the brain or hemorrhages around the brain.  They can also determine whether any internal organ damage has occurred.  If you have suffered a head injury, and lost consciousness, you will likely be kept overnight in the hospital, for observation.  If you are hesitant to stay, don’t be.  If is for your safety and protection.

Finally, it is also important to realize that there have been serious damages which have occurred.  There will be property damages, personal injury damages, medical costs, lost wages, anxiety, worry, etc.  The rights of the motor vehicle injury victim must be protected.  The best course of action is to seek an attorney who has significant expertise in personal injury.

Personal injury lawyers may specialize in this area of the law.  There are many areas of legal specialization, such as divorce law, criminal law, contract law, healthcare law, and there are also attorneys who specialize in personal injury law.  They will be the best experts to guide as to protect your rights, and help injury victims receive compensation for their losses, as well as cover medical expenses.  Motor vehicle / truck accident  lawyers often work on a fee contingency basis, which means that the injury victim / patient does not pay for their legal representation unless they are awarded money from the other party.  This helps protect the rights of the patient, who otherwise might not be able to bear the expense of a personal injury attorney.
